The enforcement of the right to quality education as an action of the Public Prosecutor’s Office of Pernambuco

Resumo: The so-called Doctrine of comprehensive protection is based on Article 227 of the 1988 Federal Constitution of Brazil and regulated by the Child and Youth Statute. By this provision, the conceptions of education will be influenced and reconfigured so that the desired protection is guaranteed, placing as joint liability the so-called Guarantee of the Rights of Children and Youth System ( Sistema de Garantia de Direitos da Criança e do Adolescente – SGDCA ), which aims to respond to the demands for rights of children and adolescents. In this sense, the Public Prosecutor’s Office emerges as a co-responsible agent to achieve the right to education, promoting the dignity of the human person. This paper aims to identify the mechanisms and contingencies involved in the working practices of the Public Prosecutor’s Office in the State of Pernambuco, Brazil, to enforce the right to quality of basic education circumscribed in the project of the Public Prosecutor’s Office for Education ( Ministério Público pela Educação – MPEduc ) project. This is a cutoff of a doctoral research that, for this text, conducted a review of the national legislation, documents produced within the scope of the project and a bibliography concerning education as a human right. The analysis of the actions resulting from the project found that fulfilling the goals and purposes of the MPEduc is based on the principles of comprehensive protection for children and adolescents, as prescribed in the Child and Youth Statute and in the Brazilian Constitution. In order to accomplish its working functionality, the Public Prosecutor’s Office of Pernambuco turns out to be an important ally for the restoration of educational rights, with a view to achieving the desired quality. For this purpose, public civil inquiries and subsequent recommendations for adjustments to education policies are used.

Por tal dispositivo, as concepções de educação vão ser influenciadas e reconfiguradas para que sejam asseguradas a proteção pretendida, depositando como responsabilidade solidária o chamado Sistema de Garantia de Direitos da Criança e do Adolescente (SGDCA), que tem como finalidade responder às demandas por direitos infantoadolescentes. Nesta acepção, o Ministério Público desponta como agente corresponsável para a consecução do direito à educação, promovendo a dignidade da pessoa humana. Este artigo tem como objetivo identificar os mecanismos e as contingências implicadas nas práticas laborais do Ministério Público de Pernambuco para assegurar o direito à qualidade da educação básica circunscrita no projeto Ministério Público pela Educação (MPEduc). Trata-se de um recorte de pesquisa de doutoramento que, para este artigo, procedeu uma revisão da legislação nacional, dos documentos produzidos do âmbito do projeto e de uma bibliografia concernente à educação como direito humano. A análise das ações resultantes do projeto constatou que o cumprimento das metas e finalidades do MPEduc fundamenta-se nos princípios da proteção integral infantoadolescente, conforme prescrito no Estatuto da Criança e do Adolescente e na Constituição do Brasil. Em cumprimento da sua funcionalidade laboral, o Ministério Público de Pernambuco configura-se como importante aliado para a restauração dos direitos educacionais, com vistas à consecução da qualidade almejada. Utiliza-se, para tal fim, de inquéritos civis públicos e posteriores recomendações de ajustes às políticas educacionais.Universidade de São Paulo.
