Resumo: | This paper aims at the critical analysis of the contours and limits of the right to refuse health care in the Federal Council of Medicine Resolution No. 2,232/2019. This is a theoretical research carried out from a juridical-dogmatic and comprehensive-propositive perspective, based on the notion of private autonomy as a fundamental right. Contrary to the provisions of the Federal Council of Medicine’s Resolution, the conclusion was that the right to the free development of personality encompasses, as a rule, the possibility of medical refusal, through express, unambiguous, free, informed and very personal consent, even in cases of imminent risk of death. It was also found that the patient’s autonomy is disregarded in many Brazilian courts when life is threatened, and certain intervention is imposed. This behaviour is not in accordance with a Democratic State of Law and the values of the 1988 Brazilian Constitution. |

Realizou-se investigação teórica, de vertente jurídico dogmática e tipo compreensivo-propositivo, em que se vislumbrou a autonomia privada como direito fundamental. Por meio desse percurso metodológico, chegou-se à conclusão de que, contrariamente ao disposto na referida Resolução do Conselho, o direito ao livre desenvolvimento da personalidade abrange, como regra, a possibilidade de recusa terapêutica, por meio de consentimento expresso, inequívoco, livre, informado e personalíssimo, mesmo em casos de risco iminente de morte. Constatou-se também que, em muitos julgados dos tribunais brasileiros, a autonomia do paciente é desconsiderada quando a vida está ameaçada, sendo-lhe imposta determinada intervenção, conduta que não se amolda a um Estado Democrático de Direito e aos valores da Constituição Federal de 1988.
