THE QUOTA SCHEME IN UNIVERSITIES IN RELATION TO THE CONSTITUTIONAL PRINCIPLE OF EQUALITY

Resumo: | This article presents the States concern to include Afro-descendents and needy students in Brazilian public universities. It highlights the discussion created by the nomenclature used to define such behavior and indicates the non-constitutionality of the act. The article reports on the human being evolution process and it points out the sense of responsibility present in contemporary society. It clarifies the etymological meaning of the term equality and analyses the evolution in the creation of laws alongside with society’s evolution. It cites the proceedings used by universities to classify applicants who postulate a place in public higher education. The assessment of these statements was carried out through exploratory research, involving bibliographic and documental survey. The descriptive method was used and although the theme was polemic, it was possible to verify that there is a strong tendency in the legal area to favor the “quote scheme”. |

Salienta a polêmica gerada pela nomenclatura usada para definir tal comportamento. Aponta a inconstitucionalidade do ato. Discorre sobre o processo evolutivo do ser humano e ressalta o senso de responsabilidade presente na sociedade contemporânea. Clarifica o sentido etimológico do termo igualdade. Analisa a evolução da forma de elaboração das leis, lado a lado, com a evolução da sociedade. Cita procedimentos utilizados pelas universidades para classificação dos estudantes postulantes a vagas do ensino público superior. A aferição dessas assertivas foi efetivada através de uma pesquisa exploratória, envolvendo levantamento bibliográfico e documental. O método utilizado foi o descritivo.
