Resumo: The present monographic work had as general objective to analyze the repercussion of the Childfree’s movement in light of the Brazilian legal order. For this, the deductive approach was used, starting from a general premise: if the movement violates Brazilian constitutional and infraconstitutional normativity, in order to reach a specific conclusion on the subject. The level of research is exploratory, with a qualitative approach and bibliographic procedure, based mainly on doctrines, laws and academic articles. Based on the research, it can be seen that the childfree’s movement does not violate the foundations of the Federative Republic of Brazil nor the infraconstitutional legislation, regarding the Child and Adolescent Statute and the Consumer Protection Code. In addition, it does not violate Law 7.716 / 89, since it is not a discriminatory practice. Therefore, it is concluded that the movement is legitimate and does not violate rights. On the contrary, it defends the freedom of choice and the respect deserved by all, as well as the market initiative.

Para tanto utilizou-se o método de abordagem dedutivo, partindo, inicialmente, de uma premissa geral: se o movimento fere a normatização constitucional e infraconstitucional brasileira, para, ao final, chegar a uma conclusão específica sobre o tema. O nível da pesquisa é exploratório, com abordagem qualitativa e procedimento bibliográfico, fundamentado, principalmente, com doutrinas, leis e artigos acadêmicos. Com base na pesquisa verifica-se que o movimento childfree não viola os fundamentos da República Federativa do Brasil nem a legislação infraconstitucional, no que diz respeito ao Estatuto da Criança e do Adolescente e ao Código de Defesa do Consumidor. Ademais, não infringe a Lei 7.716/89, vez que não se trata de prática discriminatória. Portanto, conclui-se que o movimento é legítimo e não viola direitos.
