Prática do mobbing trabalhista: possibilidade do compliance trabalhista no combate ao assédio moral no ambiente de trabalho

Resumo: OBJECTIVE: To analyze the practice of labor mobbing and the use of labor compliace in the combat of moral harassment in the work environment. METHODS: This is a research about the level of objectives, exploratory; about the procedure of data collection, bibliographic and documental; and the approach will be qualitative, because the work aims to compile data aimed at understanding subjective aspects that can not be translated into numbers. RESULTS: Throughout the times, workers all over the world have fought for their labor rights, to have a dignified work, being their effort detached to guarantee rights considered fundamental, through principles such as the principle of the dignity of the human person, the protective principle of the employee, the principle of in rubio pro laborer, the principle of the most favorable norm, the principle of the application of the most beneficial condition to the worker and an important right to a healthy work environment. Violence at work such as moral harassment and labor mobbing are attitudes and behaviors practiced, aiming to harm the victim of aggression, causing the same to ask for his dismissal from employment or even retaliate against his rights both can be typified as vertical descending, horizontal and vertical ascending. Violence at work in general can be individual, in which it can be about the characteristics of the individual; situational, in which it depends on where, when, and how the work is carried out; organizational, the worker runs the risk of being unemployed or even absurd goals, among other situations that can cause mental stress being a type of violence; societal, goes beyond the work environment having to do with crime. With the creation of the anti-corruption law came the tool of compliance, to avoid not only labor actions, or just be used in public companies, but also in private companies, with the implementation of codes of ethics and conduct. The importance of combating mobbing or harassment goes beyond the work environment because it harms the health of the workers, and they will seek welfare assistance if they are unable to work due to a psychological illness, creating a great social risk. CONCLUSION: The government should not only create more laws but also seek new intelligent ideas, creating tools, and one of them that presents us is the labor compliance that, as mentioned, works by creating codes of ethics and conducts, but for it to work it is necessary to work as a team from the government, to the worker who does not matter the hierarchy or position, so it is very important to apply courses, lectures, and a more comprehensive study of each aspect of the work environment.

MÉTODO: Trata-se de uma pesquisa quanto ao nível de objetivos, exploratória; quanto ao procedimento de coleta de dados, bibliográfica e documental; e de abordagem qualitativa, pois o trabalho teve como finalidade compilar dados voltado a compreender aspectos subjetivos que não podem ser traduzidos em números. RESULTADOS: Ao longo dos tempos os trabalhadores em todo o mundo lutaram por seus direitos trabalhistas, para possuírem um trabalho digno, sendo seu esforço desprendido para garantia de direitos considerados fundamentais, por meio de princípios como o da dignidade da pessoa humana, bem como o importante direito de se ter um ambiente de trabalho saudável. A violência no trabalho como o assédio moral e o mobbing trabalhista são atitudes e comportamentos praticados visando prejudicar a vítima da agressão, fazendo com que a mesma solicite sua demissão do emprego ou até mesmo revide, prejudicando assim seus direitos, ambos podem ser tipificados como vertical descendente, horizontal e vertical ascendente. A violência no trabalho em geral podem ser individuais: no qual pode ser ainda, acerca das características do indivíduo; situacionais: no qual depende de onde, quando e como o trabalho é exercido; organizacionais: onde o trabalhador corre o risco de ficar desempregado ou ainda se serem impostas até metas absurdas, entre outras situações que podem causar um estresse mental sendo um tipo de violência; societais: que vai além do ambiente de trabalho tendo haver com a criminalidade. Com a criação da lei anticorrupção surgiu a ferramenta do compliance, para se evitar não apenas as ações trabalhistas, ou apenas ser utilizado em empresas públicas, mas também em empresas privadas, com a implementação de códigos de ética e condutas. A importância do combate ao mobbing ou assédio vai além do ambiente de trabalho pois o mesmo prejudica a saúde dos trabalhadores, e os mesmos vão buscar auxílio na previdência caso fiquem impossibilitados de trabalhar por uma doença psicológica, criando assim, um grande risco social.
