Resumo: The theme of this thesis, submitted for the degree of Bachelor of Law at the University of Southern Santa Catarina, proposes to study the subject matter of joint custody, established by the national legal system as the standard form of custody, believed to promote the best interests of the child or adolescent. This study also plans to examine how joint custody is used as a way to avoid parental alienation. The scientific method used is deductive reasoning, creating an analysis based on historical concepts of family power, discussing their particularities and relevance, defining family and custody, as well as identifying joint custory as the preferred type of custody, as long as there is harmony between the parents, since this is the form which best protects the interests of the child and adolescent. The adopted procedure analyses bibliographic sources and jurisprudence in order to study the family situation.

The adopted procedure analyses bibliographic sources and jurisprudence in order to study the family situation.A temática adotada para este estudo monográfico, submetido à Universidade do Sul de Santa Catarina para obtenção do título de Bacharel em Direito, propõe um estudo relacionado ao tema do instituto da guarda compartilhada, definido como forma obrigatória de guarda pelo ordenamento jurídico, ante o brocado do melhor interesse da criança e do adolescente. Demonstra, ainda, a sua utilização como forma de prevenir ocorrência da alienação parental. O método científico utilizado é o dedutivo, iniciando um estudo geral com noções históricas do poder familiar, com suas peculiaridades e relevâncias. Após, conceitua-se família, guarda e se finaliza apontando a guarda compartilhada, sob a perspectiva de uma relação harmoniosa entre os cônjuges e como forma preferível de aplicação, visto que é a modalidade que mais atende ao princípio do melhor interesse da criança e do adolescente.
