Resumo: This conclusion paper deals with the recognition of the stable union as a family entity. On this way, the general objective of the research is to analyze if the Brazilian legal system, currently, offers protection to the rights of the partners that lives in a putative stable union. The methodology for bibliographical and documentary research to analysis and positioning doing considerations about doctrine, legislation and jurisprudence about the subject. The main conclusions reached, claim to increasingly based on social evolution, those issues related to families, the legal system does not always follow this evolution, lacking the protection of families, which are formed in parallel and seriously establish. However, it is necessary an evolutionary analysis of the concept used an end to be able to define the conception of family and consequently determine who can define this concept. Nevertheless, on the current context where one lives, it is not possible allow the much-discussed discrimination to reach those who in good faith links with others just for forming a family and living in society.

Dessa maneira, o objetivo geral da pesquisa é analisar se o ordenamento jurídico brasileiro, atualmente, oferece alguma proteção aos direitos do companheiro(a) que vive em união estável putativa. A metodologia utilizada foi a pesquisa bibliográfica e documental para analisar o posicionamento e as considerações feitas pela doutrina, legislação e jurisprudência sobre o tema. As principais conclusões averiguadas foram que, cada vez mais, a partir da evolução social, surgem questões que dizem respeito às famílias, e o ordenamento jurídico, por sua vez, nem sempre acompanha essa evolução, faltando o amparo e a proteção às famílias que se constituem de forma paralela e de boa-fé. Porém, é necessária uma análise evolutiva do conceito utilizado, a fim de poder definir a família e, consequentemente, determinar quais indivíduos podem abranger esse conceito.
