Resumo: The present work of conclusion of course returns to the important differentiation of the institutes of qualified courtship and of the stable union, above all it is not related to the affectio maritalis, besides a jurisprudential analysis on subject. The method used is deductive. The procedure is monographic. As for volume, a research and application, an impact-proof approach, is qualitative. The technical procedure used for data collection was the bibliographical one, using as research source doctrines, articles, laws and jurisprudence of the High Courts referring to the subject. In the end, it is concluded by a case-by-case analysis of the cases that arrive at the Judiciary, since there is no criterion of creation, by itself, to provide a characterization of one or another institute. Faced with constant social change, the theme, without doubt, is still the subject of substantive changes and warm doctrinal debates.

O método utilizado é o dedutivo. O procedimento é o monográfico. Quanto ao nível, a pesquisa é exploratória e, quanto à abordagem utilizada, é qualitativa. O procedimento técnico aplicado para coleta de dados foi o bibliográfico, utilizandose como fonte de pesquisa doutrinas, artigos, legislações e jurisprudência das Cortes Superiores referente ao tema apresentado. Ao final, conclui-se pela análise casuística dos processos que chegam ao Judiciário, uma vez que não há critério objetivo capaz de, por si só, ensejar a caracterização de um ou outro instituto.
