Resumo: ABSTRACT The objective of this study is evaluating the civil responsibility of employer in cases of horizontal moral harassment. The level of this work can be categorized as exploratory. The approach used was qualitative. The meanings of collecting data was bibliography and documental research. The main goal of this study is discovering how much is the employer responsible of horizontal moral harassment cases, in work relationships, inside a work environment. Considering the study about doctrine, judged people and the understanding of majority jurisprudence, the results gained with this study show that is more viable see the civil responsibility of employer like objective. Despite the several understandings, that is the one which generally prevails because it is considered the most effective in the compensative area. The responsibility of employer being objective, workers can be compensated in a fast and safety way without the necessity of guilty proof. Moral harassment is a prejudicial conduct that cause psychological injuries to health on workers so the damaged has to be repaired immediately. It is important to remember that moral harassment, studied in this document, is the horizontal one, committed by employee against employee.

Para a elaboração deste estudo, pode-se classificar a pesquisa, quanto ao nível, como exploratória; quanto à abordagem, como qualitativa; e quanto ao procedimento de coleta de dados, como bibliográfica e documental. Este trabalho tem como função principal descobrir qual a responsabilidade civil do empregador, quando se está diante da ocorrência do assédio moral horizontal no âmbito das relações trabalhistas. O resultado da pesquisa, obtido através da análise da doutrina, dos julgados e do entendimento da jurisprudência majoritária, mostrou que é mais viável ver a responsabilidade civil do empregador como objetiva. Apesar dos diversos entendimentos, este é o que geralmente prevalece, pois é considerado o mais eficaz na área indenizatória. Assim, sendo ela objetiva, os trabalhadores podem ser ressarcidos de uma forma rápida e segura, sem a necessidade de comprovar culpa. Como o assédio moral é uma conduta nociva, que afeta psicologicamente a saúde dos trabalhadores, faz-se necessário reparar urgentemente os danos sofridos.
