Reforma trabalhista prevista na Lei 13.467/2017 e os reflexos na extinção do contrato de trabalho

Resumo: The present research addresses “Labor reform provided for in Law No 13.467/2017 and the reflexes in the extinction of the employment contract”. This research has as its general objective verify the impact that the labor reform brought by the Law No 13.467/2017 in the extinction of the employment contracts, being this one of the alternatives to reduce the effects of an economic crisis and a growing number of unemployment in the country. For greater understanding about the subject the research is divided in three chapters linked and structured to each other. The first chapter treats about the evolution of the labor rights in history, as well as the outdating of the Decree-Law No 5.452/43, and labor principles most confronted by the labor reform. The second is about the employment contract in the Brazilian labor law, pointing out its peculiarities, modalities and the ways they were extinguished by the Workers Law Consolidation of 1943. The third, therefore, last chapter treats about the problem itself, showing the flexibilization that the new legislation brought to the labor standards, as well as the possible improvements or worsening, attempting the form in which the dissolution of the labor contracts will be given. The research adopts the deductive approach method, starting from a general situation for a particular idea, method of monographic procedure and the technique of bibliographic research. The final result of the survey leads to the conclusion that the reform can be applied, however some devices are controversial, but overall, the impact on the dissolution of the employment contract, and the new procedure of the labor dissolution, will benefit the parties of an employment relationship.

Essa pesquisa tem como objetivo geral verificar o impacto que a reforma trabalhista trazida pela Lei nº 13.467/2017 na extinção dos contratos de trabalho, sendo essa uma das alternativas para amenizar os efeitos de uma crise econômica e um crescente número de desemprego no país. Para maior entendimento sobre o tema a pesquisa é dividida em três capítulos ligados e estruturados entre si. O primeiro capítulo trata da evolução do direito trabalhista na história, bem como a desatualização do Decreto Lei nº 5.452/43, e princípios trabalhistas mais confrontados pela reforma trabalhista. O segundo versa sobre o contrato de trabalho no direito trabalhista brasileiro, apontando suas peculiaridades, modalidades e as formas como eram extintos pela Consolidação das Leis Trabalhistas de 1943. O terceiro, portanto, último capítulo trata do problema em si, mostrando a flexibilização que a nova legislação trouxe as normas trabalhistas, bem como as possíveis melhoras ou pioras desta, atentando a forma em que se dará a dissolução dos contratos trabalhistas. A pesquisa adota o método de abordagem dedutivo, partindo de uma situação geral para uma ideia particular, método de procedimento monográfico e a técnica de pesquisa bibliográfica.
