The present research consists of analyzing critically the socio-affective paternity under the inherent aspects of Family Law. Consequently, to verify how this new bond of affiliation that is formed with the evolution of the families, causes that a development of an adjustment in the current society and in its legal order. Analyzing the socioaffective paternity, the fundamental relevance of the affective bond in the relationships is observed, based on the coexistence, dedication and reciprocal companionship, making the biological ties assume a position of less relevance in the relations of paternity. Therefore, it remains evident that socio-affective children have the same rights and duties of children with consanguineous bonds. Based on this research, it is concluded that the family nucleus, resulting from socio-affective affiliation, became a primary area of affectivity among their peers and that legislation applicable to Family Law has been gaining innovations following the new family arrangements and the different situations which arise from them. The research uses the deductive method involving bibliographic research.
