Dano extrapatrimonial nas relações de emprego, à luz da reforma trabalhista

Resumo: OBJECTIVE: To analyze the innovations about the extra-patrimonial damage in labor relations brought about by the Labor Reform from Law n. 13,467 of 2017. METHOD: For the present study, the deductive method was used as the method of approach. As for the depth of the research, the exploratory method and the bibliographic procedure were used, through books, doctrines, scientific articles and the Brazilian legislation itself. RESULTS: Through this monographic work, it was verified the off-balance-sheet damages occurring in the labor sphere and its need for specific legislation on the subject, since the Consolidation of Labor Laws was faulty in this matter, due to its antiquity. It happens that, the Labor Reform had happened with exacerbated speed, bringing some institutes incompatible with the Greater Law. CONCLUSION: It is concluded that, although important innovations brought by the Labor Reform of 2017 some institutes are inconsistent with the Brazilian Federal Constitution of 1988, showing greater care in determining the compensation as a result of extra-legal damages in the labor scope.

MÉTODO: Para o presente trabalho, foi utilizado como método de abordagem o dedutivo. Quanto ao nível de profundidade da pesquisa, utilizou-se o método exploratório e o procedimento bibliográfico, através de livros, doutrinas, artigos científicos e a própria legislação brasileira. RESULTADOS: Verificou-se através desse trabalho monográfico os danos extrapatrimoniais ocorridos no âmbito trabalhista e sua necessidade de legislação própria acerca do tema, visto que a Consolidação das Leis Trabalhista encontrava-se falha nesse assunto, devido a sua antiguidade. Ocorre que, a Reforma Trabalhista acontecera com exacerbada velocidade, trazendo alguns institutos incompatíveis com a Lei Maior.
