OBJECTIVE: The purpose of this monograph was to analyze the decisions of the Court of Justice of the State of Santa Catarina on the application of the principles of social function and preservation of the company and its foundations, in the judicial recovery, in the period between June/2017 to February/2020. In this scenario, it presented itself as a research problem: what is the position of the Court of Justice of the State of Santa Catarina on the application of the principles of social function and the preservation of the company and its foundations in judicial recovery? METHOD: In terms of methodology, the exploratory nature was adopted, with a qualitative approach, as well as bibliographic and documentary research. Regarding the corpus, ten TJSC judgments were analyzed and their main results were described in a specific chapter. RESULTS: Companies, whether individual or corporate, assume an extremely relevant role in society, this is because their activities reflect for the State, society, workers and for the entrepreneur himself, being essential to be guided by basic guidelines, being one of maintenance of the principles of social function and preservation of companies. CONCLUSION: After collecting and exposing the information, it was concluded that there is unanimity in the Santa Catarina State Court of Justice regarding the need to apply the principles of social function and the preservation of companies undergoing judicial reorganization.
