Resumo: | Currently it is increasing the index of children and adolescents who engage in crimes, receive educational measures and get back to commit new crimes, becoming them repeat offenders, this explains why such fact comes caring society. This work has as objective to examine whether the educational measures provided for in article 112 of ECA have in his subject forms able to re-educate the child offender, whether they are or they are not effectives and also the extent to which they can influence for reincidence. To this end, it was necessary to elaborate on the historical evolution of the rights of minors, analyzing the changes that there was until the advent of ECA. Besides to define what are child and adolescent in accordance with the ECA and discuss on the main responsible for the minor, the family, the State and society. To better understand the subject, it was presented the conceptualization of infraction act, the main factors that lead adolescents to practice infraction act and which the assessment procedure. In the course of work it was sought to examine the applicability and effectiveness of educational measures, trying to understand what are their failures. Finally, it was examined then the index of the recurrence of child offenders in Brazil. Concluding that the lack of structure in the implementation of educational measures are motivating the recurrence. As to the methodology, it was used the deductive method, consisting in explanatory research. Also it was used the technique of bibliographic research, documentary, as well as legislation and other documents. |

Also it was used the technique of bibliographic research, documentary, as well as legislation and other documents.Atualmente é crescente o índice de crianças e adolescentes que praticam crimes, recebem medidas socioeducativas e voltam a cometer novos delitos, tornando-se assim reincidentes, isto explica porque tal fato vem preocupando a sociedade. O presente trabalho tem como objetivo analisar se as medidas socioeducativas previstas no artigo 112 do ECA têm, em seu bojo, meios capazes de reeducar o menor infrator, se são ou não eficazes e, ainda, até que ponto elas podem influenciar para a reincidência. Para isso, foi necessário discorrer sobre a evolução histórica dos direitos dos menores, analisando as mudanças que houve até o advento do ECA. Além de definir o que são criança e adolescente de acordo com o ECA e discutir sobre os principais responsáveis pelo menor, sendo a família, o Estado e a sociedade. Para melhor compreender o assunto, apresentou-se a conceituação de ato infracional, os principais fatores que levam o adolescente à prática do ato infracional e ainda qual o procedimento de apuração. No decorrer do trabalho buscou-se analisar o índice de aplicabilidade e eficácia das medidas socioeducativas, procurando compreender quais são suas falhas. Por fim, passou-se a analisar então o índice de reincidência dos menores infratores no Brasil. Concluindo-se que a falta de estrutura na aplicação das medidas socioeducativas estão motivando a reincidência. Quanto à metodologia empregada, utilizou-se do método dedutivo, consistindo em uma pesquisa explicativa.
