The purpose of the following study is expose the ways supported by the Brazilian legal system to make feasible ventures, reducing the total cost of the project by repair obligation limits in cases of non-compliance with the object of the contract or partial compliance. In order to contextualize and prepare the bridge between the technical and economic aspects, the paper will briefly discuss the concepts of risk and how to identify them, performance guarantees in the contractual and the cost of risk, going to the differentiation between liability and obligation to indemnify, that those are already matters strictly of the Law and that will give the background for the study of the contractual clauses of limitation of the obligation to repair. And finally after all the technical approach on the legal aspects the study proposes an organized way to mechanize this process of risk analysis and direct the responsibilities with legal protection. The paper concludes with a succinct recapitulation clarifying the proposed logical line.
