The Judiciary in the political crisis: the public “short messages” of the Federal Supreme Court

Resumo: The article aims at analyzing the conjuncture of the current political crisis in Brazil. It introduces a new element as analytical tool: the presence of Justice on the public agenda, and specifically deals with pieces of communication extracts of the Federal Supreme Court. By behaving as a political actor the Judiciary positions itself before the Executive and the Legislative in using communication. Additionally, it is worth mentioning that the Judiciary still uses such communcation public short messages to give vent to its internal disputes. This means that, what was previously restricted to the backstage and procedural processes, gains a mediatic and public dimension. In the Brazilian crisis this development is intensified because it represents the Judiciary's affirmation capacity. Summing up, this paper proposes some ideas that help us understand the relationship between the Justice System and public opinion while considering the importance of the Supreme's public behavior as part of the political game.

Ao se comportar como ator político, além das questões normativas, o Poder Judiciário também se coloca diante do Executivo e do Legislativo fazendo uso da comunicação. Vale destacar que o Judiciário ainda se utiliza de tais “recados” para dar vazão a suas disputas internas, ou seja, o que antes era restrito aos bastidores e ao trâmite processual ganha uma dimensão midiática e pública. Na crise brasileira, esse movimento se intensifica porque ele compreende a capacidade de afirmação política do Judiciário.
