Regulations of Distance Education in Brazil and the Impact of Ordinance No. 343/2020 on Higher Education

Resumo: Distance Education (DE) enables the democratization of teaching by breaking the space-time paradigm and respecting the population heterogeneity. In a country with continental dimensions like Brazil, DE fits with a glove, and for this reason it has had enormous attention of the federal government. This institution has edited several Decrees and Laws to regulate and qualify their exercise, expanding and supervising its offer, including in higher education. This qualitative research was carried out in two stages. The first aimed to make a survey of the main government norms regarding DE in Brazil. The second stage consisted of observing the general panorama of education after the decree of Ordinance No. 343 of 17 March 2020, and its reflexes in in-class course of higher education. The successive decrees linked to distance education provided not only to increase an offer of places in the higher education but also the quality by establishing well-defined criteria for accreditation, supervision, and evaluation of courses. It was also glimpsed that, in this moment of Covid-19 pandemic, DE will be a fundamental piece for Brazilian education, as long as there are investments in Higher Education Institutions, both in the structural and technological area, as in teacher training. Attention should also be given to less favored students who do not have internet access, so that DE does not become an instrument of social exclusion. Keywords: Legislation. Federal Government. Coronavirus. ChallengesA Educação a Distância (EaD) possibilita a democratização do ensino ao quebrar o paradigma espaço-tempo e respeitar a heterogeneidade da população. Em um país com dimensões continentais como o Brasil, a EaD se encaixa com uma luva, e por isso tem tido enorme atenção por parte do governo federal. Ele tem editado diversos Decretos e Leis visando regulamentar e qualificar seu exercício, ampliando e supervisionando sua oferta, inclusive no ensino superior. Esta pesquisa, de natureza qualitativa, foi realizada em duas etapas. A primeira objetivou fazer um levantamento das principais normativas governamentais a respeito da EaD no Brasil, e a segunda etapa consistiu na observação do panorama geral da educação após o decreto da Portaria nº 343, de 17 de março de 2020, e seus reflexos nas aulas presenciais no ensino superior. Os sucessivos decretos ligados à EaD propiciaram aumento não apenas na oferta de vagas no ensino superior, mas também em sua qualidade ao estabelecer critérios bem definidos para o credenciamento, supervisão e avaliação dos cursos. Vislumbrou-se também que, neste momento de pandemia da Covid-19, a EaD será peça fundamental para a educação brasileira, desde que haja investimentos nas Instituições de Ensino Superior, tanto na área estrutural e tecnológica, como na formação docente. Deve ser dada atenção também aos alunos menos favorecidos que não possuem acesso à internet, para que a EaD não se torne instrumento de exclusão social. Palavras-chave: Legislação. Governo Federal.
