Resumo: The relationship between technology and mankind is complex and conflicting. On the one hand, technological advancement facilitates many aspects of life; on the other hand, in the name of a collectivist ideal, it ends up infringing individual rights. In this context of progressive advancement of technology, what was once a simple science fiction now becomes a gradual reality. Considering this interlocution between fiction and reality and also the fragility of the border between utopia and dystopia, the article, through a bibliographical research of a qualitative approach and aiming for a connection between philosophy and criminology, proposes to analyze the film "Minority Report" presenting a narrative of the paradox of modernity hence the use of an infallible surveillance system that anticipates visions of the future so that criminals are punished even before the crime materializes. From this scenario, this paper contemplates on the impact of technology on the relativization of criminal and procedural rights and its principles, as well as on the fragility of the guarantee of fundamental rights through an excessive control of the State through technology, which provides a process of  turning man into objects and things. There is a paradox in trying to maximize justice and fight crime through the misuse of technologies that end up destroying freedom, self-determination and human dignity.

Editora Faculdade CERS2020-06-05info:eu-repo/semantics/articleinfo:eu-repo/semantics/publishedVersionArtigo avaliado pelos Paresapplication/pdftext/htmlhttp://revista.cers.com.br/ojs/index.php/revista/article/view/30Revista Científica Disruptiva; Bd. 1 Nr. 2 (2019): Revista Científica Disruptiva; 116-135Revista Científica Disruptiva; Vol. 1 No. 2 (2019): Revista Científica Disruptiva; 116-135Revista Científica Disruptiva; Vol. 1 Núm. 2 (2019): Revista Científica Disruptiva; 116-135Revista Científica Disruptiva; Vol. 1 No 2 (2019): Revista Científica Disruptiva; 116-135Revista Científica Disruptiva; V. 1 N. 2 (2019): Revista Científica Disruptiva; 116-135Revista Científica Disruptiva; v. 1 n. 2 (2019): Revista Científica Disruptiva; 116-1352674-7804reponame:Revista Científica Disruptivainstname:Centro de Ensino Renato Saraiva (CERS)instacron:CERSporhttp://revista.cers.com.br/ojs/index.php/revista/article/view/30/20http://revista.cers.com.br/ojs/index.php/revista/article/view/30/87Copyright (c) 2020 Revista Científica Disruptivahttps://creativecommons.org/licenses/by/4.0/deed.pt_BRinfo:eu-repo/semantics/openAccessVerbicaro, Loiane PradoTrindade, Laiza Inez MacielCampos, Márcia Carvalho2021-07-08T17:33:33Zoai:ojs2.192.168.11.14:8080:article/30Revistahttp://revista.cers.com.br/ojs/index.php/revista/indexPRIhttp://revista.cers.com.br/ojs/index.php/revista/oairevista@cers.com.br2674-78042674-7804opendoar:2021-07-08T17:33:33Revista Científica Disruptiva - Centro de Ensino Renato Saraiva (CERS)false
