The (un) control of technology in the criminal system in light of modernity paradox: an analysis of the film “minority report”

Resumo: | The relationship between technology and mankind is complex and conflicting. On the one hand, technological advancement facilitates many aspects of life; on the other hand, in the name of a collectivist ideal, it ends up infringing individual rights. In this context of progressive advancement of technology, what was once a simple science fiction now becomes a gradual reality. Considering this interlocution between fiction and reality and also the fragility of the border between utopia and dystopia, the article, through a bibliographical research of a qualitative approach and aiming for a connection between philosophy and criminology, proposes to analyze the film "Minority Report" presenting a narrative of the paradox of modernity hence the use of an infallible surveillance system that anticipates visions of the future so that criminals are punished even before the crime materializes. From this scenario, this paper contemplates on the impact of technology on the relativization of criminal and procedural rights and its principles, as well as on the fragility of the guarantee of fundamental rights through an excessive control of the State through technology, which provides a process of turning man into objects and things. There is a paradox in trying to maximize justice and fight crime through the misuse of technologies that end up destroying freedom, self-determination and human dignity. |

Por un lado, el avance tecnológico facilita muchos aspectos de la vida; Por otro lado, en nombre de un ideal colectivista, uno termina infringiendo los derechos individuales. En este contexto de avance progresivo de la tecnología, lo que antes era una simple ciencia ficción ahora se convierte en una realidad gradual. Teniendo en cuenta este diálogo entre la ficción y la realidad y la fragilidad del límite entre la utopía y la distopía, el artículo, a través de una investigación bibliográfica cualitativa y un diálogo entre la filosofía y la criminología, propone analizar la película "Minority Report" que presenta una narrativa de la paradoja de la modernidad en el diseño del uso de un sistema de vigilancia infalible que sostiene visiones del futuro para que los delincuentes sean castigados antes de que se materialice el crimen. Desde este escenario, el artículo reflexiona sobre el impacto de la tecnología en la relativización de los derechos y principios penales y procesales, así como en la fragilidad de garantizar los derechos fundamentales mediante el control estatal excesivo de la tecnología, que proporciona un proceso. De la objetivación del hombre. Existe una paradoja al tratar de lograr la maximización de la justicia y la lucha contra el crimen a través del uso indebido de tecnologías que eventualmente aniquilan la libertad, la autodeterminación y la dignidad humana.A relação entre a tecnologia e o homem é complexa e conflitiva. Por um lado, o avanço tecnológico facilita muitos aspectos da vida; por outro, em nome de um ideal coletivista, acaba-se por infringir direitos individuais. Nesse contexto de progressivo avanço da tecnologia, o que antes era uma singela ficção científica agora converte-se em gradativa realidade. Considerando essa interlocução entre ficção e realidade e a fragilidade da fronteira entre utopia e distopia, o artigo, por intermédio de pesquisa bibliográfica de abordagem qualitativa, objetivando uma interlocução entre a filosofia e a criminologia, propõe-se a analisar o filme “Minority Report” que apresenta uma narrativa do paradoxo da modernidade ao projetar a utilização de um sistema de vigilância tido como infalível que realiza visões antecipadas do futuro para que os criminosos sejam punidos antes mesmo que o crime se materialize. A partir desse cenário, o artigo reflete sobre impacto da tecnologia na relativização de direitos e princípios penais e processuais, bem como sobre a fragilidade da garantia de direitos fundamentais por intermédio de um controle excessivo do Estado a partir da tecnologia, o que propicia um processo de objetificação e coisificação do homem. Vê-se um paradoxo ao se tentar alcançar a maximização da justiça e o combate ao crime por intermédio de um uso deturpado de tecnologias que acabam por aniquilar a liberdade, a autodeterminação e a dignidade humana.
