The school relations judicialization and the educators civil responsability

Resumo: The present work presents the phenomenon called school relations judicializaton, which is characterized by the Justice act in the school and its relations environment, resulting in the most variable sentences, in order to demonstrate that the education main actors don´t know how to deal with all the variables which characterize the school relations. It presents the educators duties established by the New Civil Code, the Statute of Children and Teenagers and the Customer Defense Code which, generally, are not educators study target. It exemplifies the school relation problems that are taken to the Justice and orders the jurisprudence. Finally, it proposes a new pact envolving the educational actors (teachers, managers and community) in order to prepare the educators so they can give directions and make decisions about the school environment, becoming effective school relations protagonists

Presenta los deberes de los educadores instituidos por el Nuevo Codigo Civil, por el Estatuto de los Infantes y de los Adolescentes y por el Codigo de Defensa del Consumidor que, en general, no son objeto de estudios de los educadores. Ejemplifica los problemas de la relacion escolar llevados a la Justicia y ordena la jurisprudencia. Por fin, propone un nuevo pacto entre los actores educacionales (profesores, gestores y comunidad) a fin de preparar los educadores para que puedan dar direccion y tomar decisiones sobre el universo escolar, haciendose efectivos protagonistas de las relaciones escolares.O presente trabalho apresenta o fenômeno que chamamos judicialização das relacoes escolares, que se caracteriza pela ação da Justica no universo da escola e das relacoes escolares, resultando em condenacoes das mais variadas, buscando mostrar que os atores principais da educação nao estao sabendo lidar com todas as variaveis que caracterizam as relacoes escolares. Apresenta os deveres dos educadores instituidos pelo Novo Codigo Civil, pelo Estatuto da Crianca e do Adolescente e pelo Codigo de Defesa do Consumidor que, em geral, nao sao alvo de estudos dos educadores. Exemplifica os problemas da relação escolar levados à Justica e ordena a jurisprudencia.
