THE ANTI-DISCRIMINATION CASE MANAGEMENT IN THE CIVIL PROCEDURE LAW AND INDIGENOUS PEOPLES

Resumo: Objective: The purpose of this article is to investigate the existence of anti-discrimination duties in the case management involving indigenous peoples, based on the Code of Civil Procedure. Therefore, the hypothesis presented is that, in addition to the substantive law rules, procedural rules must also respect anti-discrimination duties.Methodology: As a methodology, a qualitative approach is adopted, through a review of specialized literature and legislation.Results: It’s concluded that Brazilian civil procedural law, by adopting the case management in cooperation with the parties, also adds anti-discrimination duties to the procedural norms, allowing the adaptation of the process to the specificities of indigenous peoples, expressing the commandment of equality provided for in the Constitution and emphasizing ethnic discrimination as a prohibited criterion of anti-discrimination law.Contributions: The article contributes to the reflection that anti-discrimination duties, in addition to material norms, also reach the procedural norm and that case management (intra-procedural) is an important instrument to guarantee procedural equality for indigenous peoples.

Por tanto, la hipótesis planteada es que, además de las normas de derecho sustantivo, las normas procesales deben respetar también los deberes antidiscriminatorios.Metodologia: Como metodología, se adopta un enfoque cualitativo, a través de una revisión de la literatura y la legislación especializadas.Resultados: Se concluye que la ley procesal civil brasileña, al adoptar la gestión procesal cooperativa, con la gestión de los procesos judiciales por parte del magistrado, agrega los deberes antidiscriminatorios también dentro de las normas procesales, permitiendo la adecuación del proceso a las especificidades de los pueblos indígenas, expresando el mandamiento de igualdad previsto en la Constitución y haciendo hincapié en la discriminación étnica como criterio prohibido de la ley antidiscriminatoria.Contribuciones: El artículo contribuye a la reflexión de que los deberes antidiscriminación, además de las normas materiales, también alcanzan la norma procesal y que la gestión del proceso (gestión intraprocesal) es un instrumento importante para garantizar la igualdad de posiciones procesales de los pueblos indígenas.Objetivo: O objetivo do presente artigo é investigar a existência de deveres antidiscriminatórios na gestão judicial de processos, que envolvem povos indígenas, a partir da análise do Código de Processo Civil de 2015.
