School Conflicts, Spiral of Conflict and (Why Not?) Mediation

Resumo: This scientific paper contains partial results of ethnographic research, held in the city of Petropolis, Rio de Janeiro. It intends to examine conflicts that arise in schools of this town as well as the judicial and non-judicial mechanisms triggered to manage them. It contains some interviews and case studies which show that mediation is not frequently used to administrate this special kind of conflicts. People are used to submit their disputes directly to Judiciary Branch. The article seeks to identify the reasons why, despite all the national movement towards consensual conflict solutions, many school conflicts are solved through local justice, with important consequences for everyone involved. From this perspective, it presents a contrast between the Argentine and Brazilian traditions in the use of school mediation. The article also demonstrates the empirical incidence of the "spiral of conflict", recommending the extension of the debate on the most appropriate ways to deal with school conflicts, given their specific and unique characteristics.

Apresenta o relato de algumas entrevistas realizadas e casos observados que evidenciaram uma tendência à judicialização desses conflitos como o caminho mais comum observado, ao invés das soluções consensuais, notadamente a mediação. A partir dessa constatação empírica o artigo busca identificar as razões pelas quais, a despeito de todo o movimento nacional de estímulo às soluções consensuais, muitos conflitos escolares tendem a ser judicializados, com importantes consequências para todos os envolvidos. Nessa perspectiva, apresenta um contraste entre as tradições argentina e brasileira no emprego da mediação escolar.
