Resumo: This research aims to discuss the constitutional principle of the reasoning of judicial decisions in the Brazilian civil procedure law. It aims to show its real importance in the rule of law, in order to build a just decision, participatory, democratic, without subjectivism and arbitrariness on the part of judges. Search also analyze the innovations brought by the New Procedure Code (Law 13.105/2015) regarding the matter, since the Code ensures highlight the issue, specifically bringing the cases in which the decision will be regarded as unfounded. Elaborated through the dialetics and historical-comparative methods, the text highlights the evolution of the legislative thought as to the reasoning of judicial decisions, highlighting the main innovations resulting in the 2015 Code of Civil Procedure.
