Resumo: The author aims, in the present study, to analyze the possible existing dialogues or not between the constitutional jurisdiction in which is distant to the judicial review and their relation with democracy participatory. Therefore, there will be a previous analysis of the appearance of the constitutional jurisdiction and the judicial review in the United States and the form of conception of the European constitutional jurisdiction, primarily with the Kelsian system. From then on, the author will face the central objective of this work that is the debate about the democratic feature of this system.

Para tanto, far-se-á uma análise prévia do surgimento da jurisdicional constitucional e do judicial review nos Estados Unidos e a forma de concepção da jurisdição constitucional europeia, precipuamente com o sistema Kelseniano.
