Resumo: Analyzes the genesis construction of the Constitutional Jurisdiction through the Marbury v. Madison’s case, trial known judged in 1803, which established the foundations of judicial review and enabled the Judiciary’s power to review laws or government acts. By legal assumptions outlined in the case trial will be objectified also know the judicial review of law and also the interpretation and application of law by the Judiciary, in order to realize the jurisdiction, honoring the right of justice access and promoting the phenomenon of judicial activism allowing Judges to interpret laws and apply them according to the Human Rights catalog, domestically and internationally by performing the justice
