Adverse Possession and Familiar Figure of Home Abandonment: Contradictions and Ambiguities

Resumo: The Law No. 12.424 / 2011 entered the Brazilian legal system the institution of the family adverse possession, introducing the article 1240-A in the Civil Code. This type of adverse possession has as one of its requirements the abandonment of one of the spouses or partners of the marital home. The law had the scope to give effect to the social right to housing; however, it introduced an ambiguity in the legal system for allowing, in theory, reintroduce the discussion of the guilty element in the dissolution of the conjugal society that had been buried by Constitutional Amendment 66/2010. Such amendment had already extinguished the marriage bond dichotomy / conjugal partnership of Brazilian law and has disappeared with the guilty analysis when the couple wanted to put an end to the family relationship. This new institute of acquisition of ownership has resulted in a legal conflict with the new dimension given to the family law due the interpretation given to the family rights through fundamental rights. This legal conflict as well as its consequences for legal certainty is the theme of this work.

Esta modalidade de usucapião apresenta como um de seus requisitos o abandono de um dos cônjuges ou companheiros do lar conjugal. A referida lei teve por escopo dar efetividade ao direito social à moradia; no entanto, introduziu uma ambiguidade no sistema normativo por ter permitido, em tese, reintroduzir a discussão do elemento culpa na dissolução da sociedade conjugal que já havia sido sepultada pela Emenda Constitucional 66/2010. Tal emenda já havia extinguido a dicotomia vínculo matrimonial/sociedade conjugal do direito brasileiro fazendo desaparecer a avaliação da culpa para a dissolução da sociedade. Este novo instituto de aquisição da propriedade ensejou um conflito normativo com a nova dimensão dada ao direito de família fruto da releitura da família através dos direitos fundamentais.
