Resumo: The study aims to demonstrate that despite the discretion and the indeterminate legal concepts keep each other some point of intersection, these are different legal institutions. The discretion there is an act of choice, an act of volition. In the valuation of indeterminate legal concepts there is an act of intelligence, an act of interpretation to avail himself of the philosophical hermeneutics to provide legitimacy to the Administrative activity. We had it as methodological aspect to understanding and analytical nature of theoretical inquiry, as we attempted to reconstruct the data analyzed from the perspective of the democratic rule of law.

Na discricionariedade há um ato de escolha, um ato de volição. Já na valoração dos conceitos jurídicos indeterminados há um ato de inteligência, um ato de interpretação que deve se valer da hermenêutica filosófica para prestar legitimidade à atividade Administrativa.
