Resumo: The present study aims to discuss the aspects of the intervention of the Judiciary for the enforcement of public policies, developed by Legislative and Executive powers, with aims to accomplish the fundamental rights provided for in the Federal Constitution of 1988. The objective is to find out if there is legitimacy for the jurisdiction to control the actions of the other powers in order to give maximum effectiveness to constitutional requirements, particularly, when there is a violation of those determinations concerned with fundamental rights, since the possibility of such a measure is admitted by thought neoconstitucionalism, not violating the principles of the Democratic State of Law.
