Direito à vida e direito de locomoção durante a pandemia do covid-19: detrimento de um para a salvaguarda do outro?

During the present work, the following question will be answered: in the pandemic, in the case of a clash between the right to life and the right to locomotion, which one should overlap? Based on the current understanding of the higher courts and the analysis of the Federal Constitution of 1988, it will be possible to explain the resolution to this conflict, as well as to set the objectives for this problem. Furthermore, it will be highlighted that, even with no hierarchy between the fundamental rights, much less different valuations, in certain situations, one of the conflicting rights must yield so that the other is protected, analyzing the concrete case. The focus of the work is, within the scope of constitutional law and through the analytical method, to explain why some measures were imposed, so that it remains clear that the only intention of the State in applying them was to guarantee the integrity of life of the population, even if, for this, another fundamental right was temporarily restricted.
