Resumo: The pandemic caused by the COVID-19 virus has undoubtedly impactedthe country and the worldpolitically, legallyand socially to such an extentthat the objectivesoutlinedin the 1988 Federal Constitution has never beenso significantand criticalto securethe fundamental rights of individuals with regard to the social right to health, provided forin articles 6 and 196, of the Brazilian Constitution. The sanitary measures to contain the spread of the highly-contagious, lethal virus, such as the restriction on the right of citizens to move and travelaround the national territory,involved the controversial issue concerning the violation of the fundamental right of freedom, provided for not only in the Brazilian law, but also inthe International Treaty of the San José Pact of Costa Rica, to which Brazil is a signatory. Thus, this essayis dedicated to discuss, based on the method of balancing of fundamental rights and analysis of practical cases, the conflict between fundamental rights and the role of the Federated Statesin the resolution of conflicts in a system of cooperation and harmony between the Powers of the Republic

Thus, this essayis dedicated to discuss, based on the method of balancing of fundamental rights and analysis of practical cases, the conflict between fundamental rights and the role of the Federated Statesin the resolution of conflicts in a system of cooperation and harmony between the Powers of the RepublicA pandemia ocasionada pelo vírus COVID-19 inegavelmente trouxe reflexos políticos, jurídicos e sociais em todo o país e no mundo, de sorte que as balizas traçadas na Constituição Federal de 1988 nunca se fizeram tão importantes e fundamentais para a garantia dos direitos fundamentais dos indivíduis no que diz respeito ao direito social à saúde, prevista nos artigos 6º e 196, da Carta Magna. As medidas sanitárias para conter a disseminação do vírus altamente contagioso e letal, como a restrição ao direito de locomoção e circulação dos cidadãos em território nacional, envolveu o polêmico tema concernente a vulneração ao direito fundamental de liberdade, previsto não só na norma positivada no direito interno como no Tratado Internacional do Pacto de San José da Costa Rica do qual o Brasil é signatário.
