Neoconstitutionalism: A new theory of law?

Resumo: With the traumas caused by World War II, criticisms of the juridical positivist model were made, arising a so-called neoconstitutional post-positivis current. This current has as mains bases a new understanding of the Constitution and the relation between Law and Moral in juridical decisions. Despite this new perspective, the juridical positivism persists with its reformulations created from the criticisms attributed to the neoconstitutional vision. This article aims expose the foundations of both neoconstituionalism and juridical positivism, criticize each of them, as well expose the scope of the neoconstitutional claim in relation to the Theory of Law: whether a paradigm or a finishing operation on the positive juridical building.

Tal corrente tem como principais bases uma nova compreensão da Constituição e a relação entre Direito e Moral nas decisões jurídicas. Apesar dessa nova perspectiva, o positivismo jurídico persiste com suas reformulações criadas a partir das críticas atribuída à visão neoconstitucional.
