Resumo: Something is saying about in arguing against or in favor of abortion, its effects on the mother, the right fetus' life and its social consequences. The issue of economic-social abortion at the constitutional level raises a number of issues that must be observed under the prism of legislation, doctrine and the state of development in which society is now. Thus, this article intends to address abortion in the light of the Constitution, taking into account the fundamental rights provided for in the Constitutional norm, namely: the right fetus' life and the dignity of the human person on the part of the pregnant woman. This research includes the existing doctrinal concepts and types of abortion, as well as the judicial activism that revolves around economic-social abortion.

This research includes the existing doctrinal concepts and types of abortion, as well as the judicial activism that revolves around economic-social abortion.Muito se fala ao argumentar contra ou a favor do aborto, sobre os efeitos do mesmo em relação à mãe, do direito à vida do feto e das suas consequências sociais.  A questão do aborto econômico-social em âmbito constitucional suscita uma série de temas que devem ser observados sob o prisma da legislação, da doutrina e do estado de desenvolvimento em que a sociedade se encontra atualmente. Dessa forma, o presente artigo pretende interpelar sobre o tema aborto à luz da Carta Magna, levando em consideração os direitos fundamentais previstos na norma Constitucional, quais sejam: o direito à vida por parte do feto e a dignidade da pessoa humana por parte da gestante.
