Application of in dubio pro societate in penal execution: analysis of the decisions of the São Paulo’s State Court of Justice on progressive sentencing

Resumo: This article aims to address the issue of application of in dubio pro societate in penal execution. Deeming as start point the study of the positioning of legal doctrine, the research focuses on understanding the judicial reasoning in decisions of progressive sentencing, investigating the use of in dubio pro societate. By setting this purpose, 96 appeals were analyzed, all of which judged by São Paulo’s State Court of Justice in December 2019. Given the absence of a constitutional framework for its application, discussions tackled the concept of public security and contradictions with the resocialization planning adopted by penal execution legislation. Thus, mounting evidence remain in relation to its application being based upon extralegal criteria, which justify the state of doubt regarding the merit for progressive sentencing, promoting decisions for the maintenance of a person deprived of liberty in the most rigorous regime or requiring her to undergo criminological assessment.

O presente artigo discute a questão da aplicação do in dubio pro societate na execução penal. Partindo dos posicionamentos da doutrina no processo penal e na execução penal, a pesquisa tem como foco a fundamentação judicial em decisões de progressão de regime, buscando investigar como se dá a utilização do in dubio pro societate. Para tanto, são analisados 96 agravos em execução penal julgados pelo Tribunal de Justiça de São Paulo em dezembro de 2019. Diante da ausência de amparo constitucional para a sua aplicação, discute-se o conceito de segurança pública que ele concentra e as contradições com o “plano ressocializador” adotado pela Lei de Execução Penal.
