Resumo: This dissertation aims to address two central questions: to verify whether the undesired repristinating effect arising from a declaration of unconstitutionality due to the theory of nullity applied to Brazilian law is compatible with the principle of legal certainty, and to understand if the modulation of the repristinating effect is essential to ensure legal certainty. The modulation of effects is provided for in the legislation, specifically in article 27 of Law nº. 9.868/99 and article 11 of Law nº. 9.882/99. To this end, this study analyzes both provisions, identifying the legal requirements for effect modulation. Additionally, it elucidates how the Brazilian Supreme Court utilizes such modulation and its repercussions. Concerning the principle of legal certainty, various hypotheses that may be incompatible with it are examined, with the restoration of an unconstitutional or inapplicable norm to the current Brazilian legal system being the main one
