Innovation in public policies: environmental legislation as a technological modernization tool — the case of Porto Alegre’s information highway

Resumo: | One can surely say that the lack of funding is a common complaint from all governments, who use this to justify their impotence and inaction in the face of society’s numerous demands, resulting in the absence of public policies.Therefore, it is plainly justifiable to study and make public successful experiments in using alternative instruments for public policy formulation and implementation, such as the regulation power over public services provided by the private sector through State granted concessions. This article, written as a descriptive, analytical, and critical case study based on secondarydata complemented by interviews, presents the experience of Porto Alegre’s municipal government, which, by adopting a broad understanding of the environmental legislation, has structured a new regulatory framework for the urban soil and subsoil usage, thus achieving new ways for planning and designing the city’s growth and development. |

Daí à justificativa de impotência e inação em face das inúmeras demandas que lhe chegam da sociedade é um passo, o que não raro resulta em um efetivo vácuo de políticas públicas. Portanto, justifica-se o estudo e a divulgação das experiências bem-sucedidas no uso de instrumentos alternativos para a formulação e implementação de políticas públicas, a exemplo do poder de regulação e regulamentação dos serviços de utilidade pública prestados pelo setor privado mediante concessão do Estado.
