Patents on herbal medicines in Brazil: an analysis of the status of the applications in the period 1995-2021

Brazil is one of the few countries that, in addition to biodiversity, has production of knowledge about it and market for bioproducts Understanding how Brazil has used this enormous potential for the development of inventions based on biodiversity is strategic. In this sense, this article studies the patent documents on herbal medicines deposited in Brazil between 1995 and 2021, both those of foreign origin and those that started in Brazil For this purpose, the INPI and Latipat-Espacenet databases were used. A total of 2721 documents were retrieved of which: 1191 were archived, 348 rejected, 351 deferred, and with an average decision time of 8.7 years; of which 1405 were initiated in Brazil of which: 661 were archived, 191 rejected; 154 deferred, and with an average decision time of 8.3 years. Contrary to what was imagined, the biggest obstacle is not legal, but the lack of knowledge of the patent system, or the lack of interest in continuing the patenting process. Being able to conclude that the innovation system of herbal medicines in Brazil is maturing.
