Resumo: In the Sophocles tragedies, the characters are responsible for their destiny: Fortuna acts, but the heroes concur for it to be fulfilled and accomplished. The tragedy of Antigone, staged in 441 BCE, shows the free choice that the protagonist took as a resolution: despite the Creon’s prohibition, she decides, although knowing that she will die, to bury her brother Polinice. We therefore perceive the opposition of two legal norms: athemistía, the illegality of a decision represented at Creon, which represents a special polis, the sophistical polis, as opposed to thémis or nómos, inserted in Antigone’s decision. Under this opposition, this article seeks to legally analyze Antigone. We seek to understand the struggle between natural and positive law.

A tragédia de Antígona, encenada em 441 a.C, revela a escolha livre que a protagonista tomou como resolução: apesar do édito proibitório de Creonte, resolve, embora sabendo que vai morrer por dar sepultura a seu irmão Polinice. Percebemos, portanto, a oposição de duas normas jurídicas: athemistía, a ilegalidade de uma decisão representada em Creonte, que representa uma pólis especial, a pólis sofística, em contraposição a thémis ou nómos, inserida na decisão de Antígona. Sob tal embate, o presente artigo procura analisar juridicamente a obra Antígona.
