Resumo: We investigate the decision-making mechanism of political majorities in indirect democracy and its excesses. The main goal is to inquire about the intrinsic legitimacy of the people given its primarily quantitative character. Is it enough to have a majority of the people to guarantee decision-making legitimacy? What are the risks of having the majority as a decision-making mechanism? This paper uses the hypothetical-deductive method through bibliographic analysis and data collection. The initial hypothesis to be confirmed points that people do not receive legitimacy from their numbers, but from the quality of their initiatives, and that it is not a naturally just, but prone to tyrannize minorities, and should be limited by norms. It suggests the delimitation of the spheres of how to govern and who governs through fixed norms, under the penalty of insufficient, incompetent, and negligent decisions.

El objetivo principal es indagar sobre la legitimidad intrínseca del pueblo como consecuencia de su carácter mayoritariamente cuantitativo. ¿Es suficiente tener una mayoría de personas para garantizar la legitimidad de la toma de decisiones? ¿Cuáles son los riesgos de la mayoría como mecanismo de toma de decisiones? Lainvestigación utiliza el método hipotético-deductivo mediante análisis bibliográfico y la recolección de datos. La hipótesis inicial por confirmar señala que el pueblo no recibe legitimidad de su número, sino de la calidad de sus iniciativas, y que no es un organismo naturalmente justo, sino propenso a tiranizar a las minorías, y debe estar limitado por un marco fijo. Concluye sugiriendo la delimitación de las esferas de cómo gobernar yquién gobierna a través de una norma fija, bajo pena de decisiones insuficientes, incompetentes y negligentes.Investiga-se o mecanismo decisório das maiorias políticas na democracia indireta e os seus excessos. O principal objetivo é inquirir sobre a legitimidade intrínseca do povo como consequência de seu caráter amplamente quantitativo. É suficiente haver um número majoritário do povo para garantir-se a ele legitimidade decisória? Quais os riscos da maioria como mecanismo decisório? A pesquisa tem como método o hipotético-dedutivo por análise bibliográfica e coleta de dados. A hipótese inicial a ser confirmada aponta que o povo não recebe legitimidade de seus números, mas da qualidade de suas iniciativas, e que não é um organismo naturalmente justo, mas propenso de tiranizar minorias, devendo ser limitado por norma fixa.
