THE RESOCIALIZATION OF MINOR OFFENDERS AND THE ROLE OF EDUCATION THROUGH SOCIO-EDUCATIONAL MEASURES

Resumo: In the Federal Constitution it is clear that Education is a right for all and the protection of children and adolescents are the first for their development. The socio-educational process, through the Education of minors in conflict with the law, aims to activate the method of socialization, enriching the forms of social reintegration, forming a thought and attitude in relation to the surrounding reality. This article aims to discuss the role of Education in the rehabilitation of minor offenders in compliance with socio-educational measures in an open environment. The research also brings a deductive analysis of 17 studies identified on the online platforms CAPES, LILAC's and Scielo published between 2015 and 2022, using bibliographic research, of an exploratory nature and qualitative approach. The bibliographic research indicates that the social and educational perception in relation to minors has evolved from "miniature adults" to social beings and citizens who deserve respect, dignity and have the opportunity to socially reintegrate in socio-educational measures. It is concluded that Education as an effective tool within the scope of socio-educational measures of the process of resocialization of minors in conflict with the law, should cover the minor's family, as well as greater engagement of society, where it is perceived that teachers do not always have the tools necessary for the effectiveness of this process and these educational actors (school, teachers and students) who are working on the resocialization of minors, are like “specters” invisible to the majority of Brazilian society.

El proceso socioeducativo, a través de la Educación de los menores en conflicto con la ley, pretende activar el método de socialización, enriqueciendo las formas de reinserción social, formando un pensamiento y una actitud en relación con la realidad circundante. Este artículo tiene como objetivo discutir el papel de la Educación en la rehabilitación de menores infractores en el cumplimiento de las medidas socioeducativas en un ambiente abierto. La investigación también trae un análisis deductivo de 17 estudios identificados en las plataformas en línea CAPES, LILAC's y Scielo publicados entre 2015 y 2022, utilizando investigación bibliográfica, de naturaleza exploratoria y enfoque cualitativo. La investigación bibliográfica indica que la percepción social y educativa en relación a los menores ha evolucionado de “adultos en miniatura” a seres sociales y ciudadanos que merecen respeto, dignidad y tienen la oportunidad de reinsertarse socialmente en medidas socioeducativas. Se concluye que la Educación como herramienta eficaz en el ámbito de las medidas socioeducativas del proceso de resocialización de los menores en conflicto con la ley, debe abarcar a la familia del menor, así como una mayor implicación de la sociedad, donde se perciba que los docentes no siempre cuentan con las herramientas necesarias para la efectividad de este proceso y estos actores educativos (escuela, docentes y alumnos) que trabajan en la resocialización de los menores, son como “espectros” invisibles para la mayoría de la sociedad brasileña.Na Constituição Federal fica claro que a Educação é um direito de todos e a proteção à criança e ao adolescente são primícias para o desenvolvimento desses. O processo socioeducativo, por meio da Educação de menores em conflito com a lei, visa ativar o método de socialização, enriquecendo as formas de reinserção social formando um pensamento e atitude em relação à realidade circundante. O presente artigo tem como objetivo discorrer sobre o papel da Educação na ressocialização do menor infrator em cumprimento de medidas socioeducativas em meio aberto. A pesquisa também traz uma análise dedutiva de 17 estudos identificados nas plataformas on Line CAPES, LILAC´s e Scielo publicados entre 2015 a 2022, utiliza-se a pesquisa bibliográfica, de caráter exploratória e abordagem qualitativa. A pesquisa bibliográfica indica que a percepção social e educativa em relação aos menores, evoluiu de “adultos em miniatura” para seres sociais e cidadãos que merecem respeito, dignidade e tem nas medidas socioeducativas a oportunidade de se reintegrarem socialmente.
