MORAL HARASSMENT AT WORK AND THE DEFENSE OF HUMAN PERSON'S DIGNITY UNDER THE VIEW OF LABOR JURISPRUDENCE

Resumo: The objective of this research was to discuss the moral harassment institute in the workplace, considering its characterizing elements, species, parallel figures, as well as to draw a profile of the Judiciary Power, when analyzing the judgments of the Regional Courts and Superior Labor Court, aiming at the reflection on how the Courts are deciding the cases submitted to it and also the types of moral harassment related to abusive practices in the workplace. The principle of the dignity of the human person is the guiding standard for all relationships, personal or professional, and as such must be observed by employers, who have the power / duty to preserve a working environment as healthy as possible. The position of the Superior Labor Court regarding the actions of the company, with characteristics of organizational moral harassment, is in the sense that such practice is liable to compensation for moral damages, including collective damages, as it stores content with the public interest. The forms of subjugation of human beings, exemplified here by moral harassment, demonstrate the immaturity of society which must be made aware of the burdensome and veiled damages that occur daily in the workplace.

O princí­pio da dignidade da pessoa humana é norma balizadora de todas as relações, pessoais ou profissionais, e, como tal, deve ser observado por empregadores, pois esses detém o poder/dever de preservar um ambiente de trabalho o mais saudável possí­vel. O posicionamento do Tribunal Superior do Trabalho quanto í s ações da empresa, com caracterí­sticas de assédio moral organizacional, é no sentido de que tal prática é passí­vel de indenização por danos morais, inclusive coletivos, pois guarda conteúdo com o interesse público.
