The outsourcing of labor and services is a global trend that began in the Brazilian private sector and was also used by the Public Administration. It is a management tool, materialized through a contract, which enables cost reduction and specialization in the provision of services or supply of goods, as well as allowing the contractor to concentrate on its main activities, becoming more competitive. , Public administration attempts to reduce state rigging, using partnerships, privatization, privatization, and other forms; All of them focused on this goal. To that end, the insertion of some institutes in the legal system received by both doctrine and jurisprudence, to regulate the state intervention in the economic control; The delegation of public services, agreements of collaboration with the private sector, such as contracts for the provision of services where outsourcing is inserted. The present paper exposes the problem of outsourcing in the Public Administration from a legal-administrative perspective. For that, it uses a critical-dialectic methodology based on the analysis of the specific norms, among them those derived from the New Law n. 13429/2017.
