Legal consequentialism and judicial activism in Criminal Law: deficient protection of the fundamental right to public safety

Resumo: The aim of this article, which is a qualitative study using hypothetical-dialectical and deductive methods, using the technique of doctrinal, legislative and jurisprudential research, is to discuss the phenomenon of judicial activism in the context of the expansion of jurisdictional competence beyond the materialization of individual constitutional rights not implemented by the legislature, in usurpation of the competence of the other powers, in which the Supreme Court acts as a political actor to the detriment of the legal. Political decisions in the criminal area, as a rule, in addition to the invasion of jurisdiction, do not respect the theory of judicial decision-making due to the predominant ideological bias, are not consequentialist from a social and economic point of view, and work to the detriment of the fundamental right to public safety.

O objetivo desse artigo, constituindo-se de uma pesquisa do tipo qualitativa, com métodos hipotético-dialético e dedutivo, utilizando a técnica de pesquisa doutrinária, legislativa e jurisprudencial, é debater o fenômeno do ativismo judicial em contexto de expansão de competência jurisdicional para além da materialização de direitos constitucionais individuais não implementados pelo legislador, em usurpação de  competência dos demais poderes, em que a Corte Suprema atua como ator político em detrimento do jurídico.
