Resumo: This research deals with the Brazilian punitive macrosystem, covering mainly the sanctioning systems of Criminal Law and Sanctioning Administrative Law, using the deductive method and starting from the premise that these sanctioning spheres are minor parts of this complex macrosystem. The study contemplates an analysis of the existing points of contact between Criminal Law and Sanctioning Administrative Law, under the aspect of a relative dependence or subordination of the latter in relation to the former. The approximation of these punitive microsystems was investigated under certain conditions of similarity highlighted in precedents of the European Court of Human Rights and the Federal Supreme Court, in order to understand the meaning of the mitigated independence between them. After scrutiny of the premise, the following problem situation was identified: What is the degree of binding of the criminal acquittal sentence on the same factual-evidence object of investigation in the area of ​​Sanctioning Administrative Law? As a research hypothesis, using the state of the art on the subject as a parameter, it was found that the dominant doctrine and jurisprudence defend the independence of these punitive systems, however, it was found that there are other aspects of criminal law that may reflect on the field of action of Sanctioning Administrative Law. It was found that a new hermeneutical line emerges in doctrine and jurisprudence that rejects punishment in duplicity (ne bis in idem) under the argument of the mitigated independence of these sanctioning spheres. The present research was developed in this north with the purpose of defining a sanction model based on the mitigated independence of the punitive spheres with hierarchical ascendancy of the Criminal Law.

El estudio contempla un análisis de los puntos de contacto existentes entre el Derecho Penal y el Derecho Administrativo Sancionador, bajo el aspecto de una relativa dependencia o subordinación de este último en relación con el primero. La aproximación de estos microsistemas punitivos fue investigada bajo ciertas condiciones de similitud resaltadas en precedentes del Tribunal Europeo de Derechos Humanos y el Tribunal Supremo Federal, con el fin de comprender el significado de la independencia mitigada entre ellos. Luego del escrutinio de la premisa, se identificó la siguiente situación problemática: ¿Cuál es el grado de vinculación de la sentencia absolutoria penal sobre la misma prueba fáctica objeto de investigación en el ámbito del Derecho Administrativo Sancionador? Como hipótesis de investigación, tomando como parámetro el estado del arte en la materia, se encontró que la doctrina y jurisprudencia dominante defienden la independencia de estos sistemas punitivos, sin embargo, se encontró que existen otros aspectos del derecho penal que pueden reflexionar sobre el ámbito de actuación del Derecho Administrativo Sancionador. Se constató que emerge una nueva línea hermenéutica en la doctrina y la jurisprudencia que rechaza el castigo en duplicidad (ne bis in idem) bajo el argumento de la independencia mitigada de estos ámbitos sancionadores. La presente investigación se desarrolló en este norte con el propósito de definir un modelo sancionador basado en la independencia mitigada de los ámbitos punitivos con predominio jerárquico del Derecho Penal.A presente pesquisa trata sobre o macrossistema punitivo brasileiro, abarcando principalmente os sistemas sancionatórios do Direito Penal e do Direito Administrativo Sancionador, recorrendo ao método dedutivo e partindo da premissa que essas esferas sancionatórias são peças menores deste complexo macrossistema. O estudo contempla uma análise dos pontos de contato existentes entre o Direito Penal e o Direito Administrativo Sancionador, sob o aspecto de uma relativa dependência ou subordinação do segundo em relação ao primeiro. A aproximação desses microssistemas punitivos foi investigada sob determinadas condições de similitude destacadas em precedentes do Tribunal Europeu dos Direitos do Homem e do Supremo Tribunal Federal, para compreender o significado da independência mitigada entre eles. Após o escrutínio da premissa, identificou-se a seguinte situação problema: Qual o grau de vinculação da sentença absolutória criminal sobre o mesmo conjunto fático-probatório objeto de apuração na seara do Direito Administrativo Sancionador? Como hipótese de pesquisa, tendo como parâmetro o estado da arte sobre a temática, apurou-se que a doutrina e a jurisprudência dominantes defendem a independência desses sistemas punitivos, porém, verificou-se que existem outros aspectos valorativos do Direito Penal que podem refletir no campo de atuação do Direito Administrativo Sancionador. Constatou-se que exsurge na doutrina e na jurisprudência uma nova linha hermenêutica que repele a punição em duplicidade (ne bis in idem) sob o argumento da independência mitigada dessas esferas sancionadoras.
