Representative democracy and legitimacy crisis: the need for an evaluation of the act of government

Resumo: Firstly, to get to the topic, an analysis of the concept of people as the holder of political power in its different conceptions was made, treated from the theory of Fredrich Müller. At the end of the analysis, it was possible to verify that many governments call themselves democratic and use the word “people” to legitimize their mandate. In the second chapter, there was an exposition of the thoughts of some authors about the apparent crisis of representativeness established in society, such as: Paulo Bonavides; Lenio Luiz Streck and Hans Kelsen. In this context, it was possible to glimpse that the absence of sufficient mechanisms ends up corroborating so that the will of the people is not effectively represented by the elected. In the third chapter, the factors that contribute to the mismatch of the representative system with the will of the people were pointed out, such as: corruption in politics, party infidelity and social exclusion. In the end, it was found that society lives in a moment of political apathy, so what presents itself as a crisis of representativeness can actually be translated into the need for a revaluation of the act of governing. For the development of the research, the deductive method was used, that is, part of general principles and prepositions to reach more specific conclusions.

Al final del análisis, se pudo constatar que muchos gobiernos afirman ser democráticos y utilizan la palabra “pueblo” para legitimar su mandato. En el segundo capítulo se expone el pensamiento de algunos autores sobre la aparente crisis de representación instaurada en la sociedad, como: Paulo Bonavides; Lenio Luiz Streck y Hans Kelsen. En este contexto, se pudo constatar que la ausencia de mecanismos suficientes termina corroborando que la voluntad del pueblo no está efectivamente representada por los electos. En el tercer capítulo se señalaron los factores que contribuyen al desajuste del sistema representativo con la voluntad del pueblo, tales como: corrupción en la política, infidelidad partidaria y exclusión social. Al final, se constató que la sociedad vive en un momento de apatía política, por lo que lo que se presenta como una crisis de representación se puede traducir en realidad en la necesidad de una revalorización del acto de gobernar. Para el desarrollo de la investigación se utilizó el método deductivo, es decir, parte de principios y preposiciones generales para llegar a conclusiones más específicas.Primeiramente, para adentrar ao tema foi feita uma análise da concepção de povo como titular do poder político em suas diferentes concepções, tratadas a partir da teoria de Fredrich Müller. Ao final da análise, foi possível constatar que muitos governos se autoproclamam democráticos e utilizam a palavra “povo” para legitimar o seu mandato. No segundo capítulo, houve a exposição dos pensamentos de alguns autores sobre a aparente crise de representatividade instaurada na sociedade, tais como: Paulo Bonavides; Lenio Luiz Streck e Hans Kelsen. Neste contexto, foi possível vislumbrar que a ausência de mecanismos suficientes acaba corroborando para que a vontade do povo não seja efetivamente representada pelos eleitos. No terceiro capítulo, foram apontados os fatores que contribuem para o descompasso do sistema representativo com a vontade do povo, tais como: a corrupção na política, infidelidade partidária e exclusão social.
