Resumo: The purpose of this research is to analyze the theory of objectification of civil procedure in the extraordinary appeal judgment. The theory brings an important feature of abstract to the concrete constitutional review. It is the "erga omnes" effectiveness of the decision. The study is based on analysis of historical basis, through the influence of comparative law and the peculiarities of each kind of judicial review. There are several assumptions that are analyzed for the study of the subject, such as legal certainty, the "stare decisis", the function of the Supreme Court, and the content of the Federal Constitution, the present Civil Procedure Code and the new Civil Procedure Code. The theme passes through the counterpoint of the jurisprudence of the Supreme Court and analyzes which implications we could have by adopting the thesis, reporting personal impressions, comments of the doctrine and positions of jurisprudence in general, providing the reader a broad view about it.

A teoria analisada transporta uma importante característica do controle abstrato para o controle concreto de constitucionalidade. Trata-se da eficácia “erga omnes” da decisão. O estudo parte da análise das bases históricas, passando pela influência do direito comparado e pelas peculiaridades de cada espécie de controle de constitucionalidade. Existem diversas premissas que são analisadas para o estudo do tema, tal como a segurança jurídica, o “stare decisis”, o papel da Suprema Corte e o que prevê a Constituição Federal, o Código de Processo Civil vigente e o novo Código de Processo Civil.
