This paper aims to analyzethe figure of the adequacy of representation and more specifically the possibility of its judicial control, case by case, on the field of collective suits. It regards an institute that is essential to the protection of collective rights, through which it is possible for the collective suit to fulfill its function to resolve legal crisis in a molecular way, with the extension of the judgment’s effects to all members of the involved community even if they did not participate in the procedural relationship.After investigating the contours of this basic requirement of collective suits both in the context ofthe US law and that of the Brazilian law, there will be proof of its intimate relation with the principle of due process and, ultimately, with the effective access to a fair legal system. Based on this analysis, it will be possible to realize the need forthe Judge to assess, in the concrete case, if the plaintiff is an adequate representative of the class and promotes the defense of their interests with commitment and technical expertise.Finally, in light of this conclusion, forecasts and delege ferendaproposals will be drawn, advocating the thesis that the judicial control of the adequacy of representation cannot be limited to civil associations and that the citizens should be given standing to seek the protection of all collective rights
