Through the present study, it was presented an academic research about the unavailability of the labor rights. It was conceptualized the labor right, with its historical base, as well as its legal nature. It was introduced the main principles of such law segment, giving emphases to the Principle of Unavailability. It was conceptualized waiver, transaction, composition and conciliation. It was discussed about the availability of the labor rights before the celebration of the labor contract, during its course and after its termination. It was dealt the assignment of labor credit accounts and the labor relations in the contemporaneous world, such as: the flexibility of the labor rights, collective negotiations, previous conciliation commissions and negotiated sectorial adequacy. Throughout the study, it was presented doctrinal dissenting and jurisprudences, and it was also presented the actual understanding of the Superior Courts
