Resumo: This work intends to analyze the contractual issues related to Labor Law, in order to deal with issues related to: (i) legal nature, (ii) general principles, and (iii) basic concepts of the Labor Law, under the perspective of Individual and Special Labor Contracts and also the possibility of autonomy to negotiate these contracts. In this sense, it was verified that the Brazilian Labor Law has limitations regarding contractual freedom, which prevents the flexibility of labor relations and also increase the informality. However, it is clear that other countries are much more advanced in terms of respect the labor agreement, such as England, where the contractual freedom, established in good faith, is applied

Nesse sentido, verifica-se que o Direito Trabalhista Brasileiro apresenta limitações da liberdade contratual das partes, impedindo a flexibilização das relações trabalhistas, o que ocasiona a informalização dos Contratos de Trabalho.
