Resumo: | The aim of this paper is to approach the labor accident, considering the law aspects that involves the protection of the labor sites, which is the place where the most different risks to the health and physical integrity of the employees happens. Mostly, accidents happens due to a series of defectives in the labor sites, such as faulty machines, using of defectives or improvised tools, lack of qualification or training of the employees, as well as, because of process and industrial activities that, due to their nature, imply in severe risks to workers. An interaction between the legal aspects that deal with labor accident and their prevention, approaching the Federal Constitution, the Consolidation of Labor Laws, the Occupational Health and Safety Code Rules of Ministry Labour also, the appropiate jurisprudence is carried out. Theories of objective and subjective civil responsibility in cases of labor accident and of compensations derived from them, such as: material, moral and esthetic damage, consonant to the present doctrine |

Theories of objective and subjective civil responsibility in cases of labor accident and of compensations derived from them, such as: material, moral and esthetic damage, consonant to the present doctrineO objetivo do presente estudo é discutir o acidente do trabalho, considerando a sistemática jurídica que envolve a proteção do meio ambiente do trabalho, que é o local onde ocorrem os mais diferentes riscos para a saúde e integridade física dos trabalhadores. No mais das vezes, o acidente acontece por uma série de deficiências existentes no ambiente laboral, tais como maquinário deficiente, uso de ferramentas defeituosas ou improvisadas, falta de qualificação ou treinamento dos empregados e, também, por causa de processos e atividades industriais que, por sua natureza, implicam acentuados riscos para os obreiros. Realizamos uma interface dos dispositivos legais que tratam sobre o acidente do trabalho e sua prevenção, abordando a Constituição Federal, a Consolidação das Leis do Trabalho, as Normas Regulamentadoras de Segurança e Medicina do Trabalho do Ministério do Trabalho e Emprego e, também, a jurisprudência pertinente.
