This graduate program monograph in labor law aims to examine the possibility of compensation for damages in cases of occupational accidents, discussing mainly the issue of moral damages in re ipsa. At first, it addresses issues such as the history of moral damage, its concept, its legal nature, which is situated in the Brazilian legal system and its constitutional foundations, and its relationship to human dignity, personal rights and the ambit of labor. Then we analyze what is meant by occupational accident and its relation to civil liability. Alongside occupational accident it is indispensable to present the analysis of the assumptions of liability, such as: tort, causation, especially the question of damages. Thereafter we address the question of the appropriateness of moral damage in occupational accidents, highlighting the situations in which moral damages can be repaired. Finally, the understanding of Regional and High Courts, doctrine, and legislation is examined, noting, above all, the enhancement of the human being in labor relations by protection of the rights to personality and dignity
