Based on the study of clinical criminology and the rise of serial killer’s phenomenon in the 1960s, especially on the international scene, this paper analyzed, empirically and theoretically, how criminal justice takes care of theses individuals, based on criminological and psychological concepts, and legal understandings of the self-determination’s capacity. Since this field still lacks with concrete data and it is in constant change, the analysis’s results, when we think about the serial killer’s culpability and the reasons for it’s manifestation, are not conclusive. In fact, this paper only wanders if the criminal legal treatment that these criminals have been receiving over the years are right. In addition, although no strategies or conclusions were established, the word identified a criminal profile of these so-called serial killers and demonstrated effective causes for this disturbance
